2. Services Offered Hosted Connection Inc. provides a comprehensive suite of services, including but not limited to:

  • IT Solutions
  • Telecommunications
  • Audio/Video Systems
  • Point of Sale (POS) Systems
  • Merchant Services
  • Network Cabling
  • Security and Access Control
  • Any network-related infrastructure and services

3. Eligibility Our services are available exclusively to legitimate business entities. The Company reserves the right to verify the legitimacy of any business at its sole discretion and may deny service without notice.

4. Free Trials The Company may, at its discretion, offer a 2-week free trial for select services. The Company reserves the right to terminate or modify trial terms without prior notice.

5. International Calling Restrictions All international calling capabilities are disabled by default. Clients seeking to enable international calling must submit a written request and will be provided with a unique access code. The Company is not liable for any misuse or fraudulent activity arising from international calls.

6. Text Messaging Usage The use of the Company’s messaging platform for unauthorized, campaign-based, or fraudulent messaging activities is strictly prohibited. Any account engaged in such activities will be subject to immediate termination. The Company reserves the right to take legal action against parties involved in malicious or unlawful messaging practices.

7. Payments, Refunds, and Cancellation

  • Refund Policy: Refunds are only issued for defective equipment. All service-related payments are final and non-refundable.
  • Contract Termination: While Hosted Connection endeavors to provide exceptional service, the Company retains the right to terminate contracts at its discretion if terms are violated.
  • Early Cancellation Fees: Clients terminating their contract before completion must pay the total amount due for the remaining contract period.
  • Equipment Ownership: Equipment provided to clients remains the property of Hosted Connection. Upon termination of services, clients must either return the equipment or pay its full original value, regardless of depreciation.

8. Service Availability and Liability The Company guarantees a 99.999% uptime for its services. However, Hosted Connection shall not be held liable for service interruptions caused by:

  • Internet Service Provider (ISP) disruptions
  • Acts of God, natural disasters, or other force majeure events
  • Client mismanagement or failure to implement recommended redundancy measures

The Company shall not be responsible for any loss, damage, or inconvenience arising from circumstances beyond its control.

9. User Responsibilities and Prohibited Activities Users agree to:

  • Provide accurate and up-to-date information
  • Use services in a lawful, ethical manner

Users are prohibited from:

  • Misusing services for malicious or unlawful purposes
  • Attempting to disrupt or compromise the Company’s network
  • Engaging in fraudulent, deceptive, or harmful activities

Violations may result in immediate account termination, with potential legal action pursued as deemed necessary.

10. Modifications to Services The Company reserves the right to modify, upgrade, or discontinue services at any time without prior notice. Changes will be communicated at the Company’s discretion, and continued use of the services constitutes acceptance of any modifications.

11. Dispute Resolution All disputes must be submitted in writing via email to legal@hostedconnection.com. The Company shall have full discretion in investigating and resolving disputes. Decisions made by the Company are final and binding to the fullest extent permitted by law.

12. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Clients agree to submit to the exclusive jurisdiction of the courts located in Orange County, California.

13. Limitation of Liability To the maximum extent permitted by law, Hosted Connection Inc. disclaims all liability for:

  • Service interruptions outside of the Company’s control
  • Client negligence or failure to implement redundancy solutions
  • Damages arising from reliance on third-party service providers

The Company’s total liability under any circumstances shall not exceed the amount paid by the client for services in the six months preceding the claim.

14. Privacy Policy The collection, use, and storage of client data are governed by the Company’s Privacy Policy. Clients should refer to the Privacy Policy for detailed information.

15. Policy Updates The Company reserves the right to amend these terms and conditions at any time without prior notice. Clients are encouraged to review the terms regularly. Continued use of the services constitutes acceptance of the updated terms.

By accessing or using Hosted Connection’s services, clients acknowledge that they have read, understood, and agreed to be bound by these terms and conditions.
